LEGAL NOTES - PRIVACY

1. Site ownership and general provisions
These terms and conditions apply to the website published at www.amaspa.com ("Terms of Use"). The owner of the Website is Ama S.p.a. ("Ama").
For the purposes of these Terms of Use, User means the person using the services offered by the Website, both for browsing and when restricted areas of the Website are accessed.
By using the Website, the User agrees to these Terms of Use; if the User does not agree with these Terms of Use, the User must not use this Website.
Additional terms and conditions of use may be established by Ama to regulate the use of individual services offered on the Website.
Any relationship arising from use of the Website shall be subject to Italian law.
Ama reserves the right to modify, add, or remove any provisions of these Terms of Use at its own discretion and at any time. The User is responsible for regularly reviewing the Terms of Use in order to check for any changes. Any use of the Website after publication of the aforesaid amendments shall imply acceptance of those changes by the User. Under the terms and conditions set forth in these Terms of Use, Ama grants the User the non-exclusive and non-transferable right to access and use the Website.

2. User's Obligations
When using the Website and the services offered on the Website, the User is required at all times to strictly comply with the law, public order and public decency and with the provisions laid down in these Terms of Use.
If the User accesses the restricted areas of the Website in order to provide, supplement or amend his/her personal data, the User agrees that he/she shall provide true information and to the extent strictly necessary for using the services provided by Ama.
After activation of the account, the User agrees to use it, as well as the related user-id and password, in a lawful and correct manner, taking also into account the legal implications associated with such use.
The User shall keep his/her credentials with due diligence and shall promptly notify any theft or loss thereof, requesting deactivation. In the absence of notice, any stated intention, acts or facts that have legal effects made by accessing the User's account shall be attributed to the User.
The User agrees not to disturb in any way the use of the Website by other users.

3. Content
The Website is protected by current Italian legislation on copyright and intellectual property.
All text, graphics, user interface, visual interface, photographs, trademarks, logos, sounds, music, artwork and computer code or other materials (collectively, "Content") on the Website, including without limitation the design, structure, selection, coordination, expression, appearance and arrangement of such Content, are owned or controlled by or licensed to Ama and are protected by the Italian legislation on copyright, patents and trademarks in force as well as other provisions on intellectual property and unfair competition.
The User is not allowed to copy, reproduce, upload, post, code, translate, transmit or distribute the Website or any part of it and its Content, through any means, computer, server or website for any purpose, other than for personal use, and in any case for commercial, publication or distribution purposes without the express written permission of Ama.
The User is also forbidden to use techniques, devices, programmes, methods or processes aimed at accessing, acquiring, copying or monitoring any portion of the Website or its Content, or at obtaining or attempting to obtain materials, documents or information by means not directly made available by the Ama Website. Ama reserves the right to block any activity pursuing those purposes.
The User must refrain from trying to obtain unauthorized access to any part of the Website or to other systems connected to it, as well as the services offered by the Website, through interception of passwords or other unlawful or otherwise unauthorized means.

4. Obligations of Ama and disclaimer
Ama undertakes to ensure the availability of the Website and the services offered on the Website, as well as the communication tools associated with them, taking care of their implementation in accordance with current progress in IT instruments.
Since some parts of the Website are located on web spaces managed by others, Ama shall accept no liability for any suspension or interruption in the service or any other limitation to the availability of the service due to technical issues of third parties or caused by factors or circumstances outside its control. The User can report any issue using the email address info@amaspa.com
Ama does not guarantee that the information on the Website shall be updated.
Ama shall not be liable for any damage and/or loss and/or malfunction of any kind that may result to the computer used by the User, or for any infection of the information system resulting from access to, interconnection with, downloading of material and software from the Website; the User shall be solely responsible for any related costs of repair and/or restoration.

5. Privacy
Ama S.p.a. is acting in accordance with the laws currently in force on the protection and security of personal data. By this document we provide the information referred to in Articles 13 and 23 of Legislative Decree 196/2003, as amended ("Privacy Code").

Processed Data
Ama does not collect any personal data of the User through the Website (e.g. name, address, phone, e-mail address), unless the User voluntarily agrees to supply them (e.g. by registering on the Website). If the User does not consent to providing such data, all or part of the services offered by the Website may not be provided.

Use and Communication data
When telecommunications services are used to access our Website, the computer systems and procedures used to operate the Website acquire, during their normal operation, some technically generated data on the type of communication (e.g. , IP addresses) or use of the Website (e.g., information on beginning, end and length of each access, and those relating to the telecommunications services to which the User is connected) which, despite not being collected for the purpose of being associated with any identified persons, could conceivably relate to personal data and enable the identification of Users, through processing and association with data held by third parties. The collection and processing of such data shall only take place in case of need. They are immediately deleted after processing. In any case, the collection and processing of such data shall be performed in compliance with the provisions of the Privacy Code.

Automatic Collection of Non-Personal Data
When the User accesses the Website, Ama system automatically (including when the User is not a registered User) collects some information that is necessarily used by Internet communication protocols and which, pursuant to the Privacy Code, does not enable the personal identification of Users (e.g. type of Internet browser and operating system used, domain name of the website from which the User has accessed the Website, number of visits to the Website, average time spent on the Website, page views).
Ama may use this information for statistical purposes and to verify the use of the Website and improve its performance or content.

"Cookies" - Information Automatically Stored on Your Computer
When the User visits the Website, Ama could store some data concerning the User's PC, in the form of "cookies" designed to automatically recognize that PC when the User next visits the Website. No personal data is acquired by the Website in this regard. The use of technical session cookies may help Ama in adjusting the Website to better meet the interests of the User or to enable saving the password entered by the User, so that it must not be re-entered at each subsequent access. If the User does not wish to receive cookies, he/she may configure the Internet browser to delete cookies from the hard disk of the computer, block them or issue a warning whenever a cookie is saved. In any case, we do not use cookies to transmit personal information, nor are persistent cookies of any kind used, or systems for tracking users.
Purpose of the processing
Pursuant to article 13 of the Privacy Code, the data collected shall be processed electronically or manually, as specified by art. 4, paragraph 1, letter a) of the Law, for the following purposes: 
a) legal obligations related to civil, tax, accounting etc. laws and regulations, managing relationships with the User, fulfilling any contractual obligations, providing support and technical information about the products and services covered by the relationship;
b) after-sales assistance, monitoring Users' satisfaction, market analysis and statistics;
c) information on future commercial activities and introduction of new products, services and offers, both by our company and our affiliates;
d) promotional and advertising activities;
e) economic and financial analysis and assessments.

Ama shall not in any case collect any "sensitive" data, as defined under art. 26 of the Privacy Code.

Rights of the party concerned 
At any time the User may exercise his/her rights with the Data Controller in accordance with art. 7 of Legislative Decree 196/2003 and specifically the right to obtain confirmation of whether any of his/her personal data are held by the company, including those still to be recorded, and their communication in intelligible form, to obtain information on the origin of such personal data and the purposes and methods of processing, the identity of the Data Controller, Data Processor and the designated representative, the persons or categories of persons to whom the personal data may be communicated or who may become aware of the data in their capacity as designated representative in the State's territory, data processors or persons in charge of processing. The party concerned is entitled to obtain the updating, rectification or supplementation of data, the deletion, transformation into anonymous form or blocking of any unlawfully processed data, and to object, in whole or in part, to the processing of his/her personal data, although pertaining to the collection purposes, and to any processing whose purpose is the sending of advertising materials or direct selling or market research or commercial communication. Security
To protect the personal data against destruction, loss or improper or accidental alteration and against unauthorized access or disclosure, Ama has designed and put in place all technical and organizational security measures as may be appropriate to ensure the confidentiality, integrity and availability of data in compliance with the provisions of the Privacy Code.

Scope of data communication and disclosure

In order to correctly fulfil the purposes of the data processing, the personal data of Users may be accessed by individuals who are authorized to such access pursuant to legal provisions, as well as by Ama collaborators, employees and staff in the performance of their duties, and by all individuals and/or legal persons whenever the disclosure of such information is necessary or appropriate to carry out the activities offered as part of the Website use.
